By accessing or using Open Qwen Image ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service. We may update these Terms from time to time, and continued use after an update means you accept the revised Terms.

Open Qwen Image provides AI image generation, reference-image workflows, prompt examples, prompt organization, and related web tools. The Service may include: • Text-to-image generation • Reference image upload and image-to-image workflows • Prompt templates, prompt rewriting, and workflow examples • Generated image history, downloads, and account-based credits • Web-based product features and API access where available

Some features require an account. You agree to provide accurate registration information, keep your credentials secure, notify us of unauthorized access, and remain responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or create security, fraud, or abuse risks.

You agree not to use the Service to: • Generate, upload, or distribute illegal, abusive, harassing, defamatory, hateful, sexualized, or exploitative content • Create deceptive impersonation, fraud, or misleading content intended to harm others • Violate intellectual property, privacy, publicity, or other rights of third parties • Upload malware, attempt unauthorized access, scrape the Service, or bypass technical limits • Generate inappropriate content involving minors • Use generated images in ways that violate applicable laws or platform policies We may remove content, limit access, or terminate accounts for policy violations.

**Your Content**: You retain ownership of prompts, uploaded images, and other content you provide. You grant us the rights needed to host, process, transform, display, and store your content to operate the Service. **Generated Images**: Subject to these Terms and applicable law, you may use generated images created through your account. You are responsible for checking whether your inputs, outputs, and intended use comply with law, third-party rights, and any model or platform restrictions. **Our Platform**: The Service, software, interface, design, documentation, and branding are owned by us or our licensors and may not be copied, modified, or reverse-engineered except as permitted by law.

**Pricing**: Current plans and credit rules are available at https://openqwen.art/pricing. **Billing**: Paid plans may be billed in advance on a recurring basis. You authorize payment processors to charge your selected payment method. **Credits**: Image generation may consume credits depending on model, resolution, workflow type, and promotional rules. **Refunds**: Payments are generally non-refundable except where required by law or stated in a specific offer. **Cancellation**: You may cancel a subscription according to the cancellation flow shown in your account or payment provider.

We may review prompts, uploaded files, generated images, and usage patterns to operate the Service, enforce these Terms, prevent abuse, and comply with legal obligations. We may remove content or restrict access when we reasonably believe it violates these Terms, creates risk, or is required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AI-generated images may be inaccurate, unexpected, biased, or unsuitable for your intended use. You are responsible for reviewing outputs before publication, commercial use, or distribution.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES. Our total liability for claims relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses arising from your use of the Service, your content, your generated images, your violation of these Terms, or your violation of third-party rights or applicable law.

We may suspend or terminate access to the Service for violation of these Terms, fraud, abuse, non-payment, security risk, legal requirement, or discontinuation of the Service. After termination, your right to use the Service ends, though certain provisions of these Terms will continue where their nature requires it.

These Terms are governed by applicable law, without regard to conflict-of-law rules. Before filing a formal claim, both parties agree to try to resolve disputes through good-faith communication. Some rights may vary depending on your country, state, or province.

**Severability**: If any provision is found unenforceable, the remaining provisions remain in effect. **No Waiver**: Failure to enforce a provision does not waive our right to enforce it later. **Assignment**: You may not assign these Terms without our consent. We may assign them as part of a business transfer or legal reorganization. **Entire Agreement**: These Terms and the Privacy Policy are the agreement between you and us for use of Open Qwen Image.
